Aeropostale files bankruptcy complaint

The mall-based retailer filed for bankruptcy in May of 2016. Now, the company has filed a complaint to bankruptcy court against its debtors.

In a complaint filed in U.S. Bankruptcy Court against Hilco Merchant Resources, Gordon Brothers Retail Partners and Aero Opco, Aeropostale claims it is owed more than $1 million.

“Plaintiffs bring this action to obtain an order directing Defendants to turnover $1,335,471.84, the amount of a vendor deposit made by the Debtors to Star Fancy Holdings in July 2016 as a prepayment for certain goods, that Defendants are wrongfully withholding from the estates. On September 13, 2016, shortly after the Debtors paid the Deposit to Star Fancy, the Court approved the sale of substantially all of the Debtors’ business to Aero OpCo (the ‘Sale’),” the complaint outlined.

This is not the first legal battle the youth-targeted clothing company has faced. In July of 2016, it filed a motion against Sycamore Partners, claiming the private equity firm was scheming to put the retailer out of business.
 
Aeropostale filed for chapter 11 bankruptcy in May of 2016, and in September landed a deal that would allow it to keep 230 of its 800 stores open. It announced plans to reopen 500 more stores in January of this year.
